Mobile App terms and conditions
1. Introduction
1.1. These terms and conditions (the “Terms”) relate to the use of our Cambridge Building Society Mobile Service (the “Service”) through The Cambridge Money App (the “App”).
1.2. You should read these Terms before using the Service. These Terms supplement any terms and conditions which apply to your Cambridge Building Society accounts.
1.3. In these Terms:
a) “Licence” means a non-assignable, non-transferable and non-exclusive licence to use the App and Service subject to these Terms;
b) “Mobile Device” means a portable computing appliance such as a smartphone or tablet computer;
c) “Our/us/we” means the Cambridge Building Society;
d) “OS” means Operating Systems supporting the App or Service;
e) “Security Details” means your secure login details and any other secure measures in place for accessing the Service and App.
f) “You/your” means the person downloading, installing and running the App and/or using the Service.
1.4. The Service provided through the App allows you to:
a) view your balance on any of your accounts registered for use with the Service;
b) make transfers to your other Cambridge Building Society savings accounts registered for use with the Service;
c) make external payments to nominated accounts (a limit may be set from time to time on external payments and you should refer to the “withdrawals” section of terms which apply to your Cambridge Building Society accounts);
d) change selected personal details and process forward dated payments;
e) read and send messages through the secure messaging service and we will be able to complete specified tasks on your behalf if requested by this method;
f) carry out other functions that we may make available to you from time to time.
2. Eligibility, Registration and Access
2.1. To use the App and Service you must:
a) have a mortgage or savings account with us;
b) be registered to view or manage your accounts online ;
c) download the App and register with your online login details.
2.2. To access the Service through the App you can setup a biometric login (available on some Mobile Devices) and/or create a secure 5 digit passcode on your Mobile Device when registering. This biometric login or 5 digit passcode will be required each time you logon to the App. You should keep your Security Details confidential at all times.
2.3. We do not charge for use of the App and you are responsible for any charges of your mobile network operator in relation to downloading and using the App and Service on any Mobile Device. Such charges vary between operators and location. If you are accessing outside the UK, the charges may be greater.
2.4. We reserve the right to introduce a charge for the App in the future and if this is the case you will be notified at least 30 days prior to the charge being introduced with the option to cease use.
2.5. You are required to provide us with an up to date mobile number and email address to continue use of the service.
2.6. We reserve the right to decline to register you for the Service without reason.
3. Using the App and Service
3.1. We grant you a Licence to use the App and Service upon your acceptance of and compliance with these Terms.
3.2. By downloading and installing the App on your Mobile Device and whilst the App is installed on your Mobile Device you are accepting the Terms and we grant you a Licence only to use the Service and App in accordance with these Terms.
3.3. You must only install the App from a site approved by us. We only approve downloads from the Apple App Store or Google Play and you should only install or use it on a compatible Mobile Device.
3.4. You are not permitted to assign, transfer or sub-license or grant any other rights in respect of the App to any other person.
3.5. You must not copy or in any way reproduce or attempt to reproduce or otherwise make available to others the App in whole or in part.
3.6. You must not alter, adapt, vary or modify, dissemble, decompile or reverse-engineer the App in any way whatsoever. All ownership in the App remains with us.
3.7. You must not use or attempt to use the App or Service for any malicious or unlawful purpose or any other way which does not comply with these Terms.
3.8. You must not use the App on a Mobile Device that has been rooted. A rooted Mobile Device is one that has had limitations and/or configurations of the Mobile Device removed without the manufacturer or mobile network’s approval.
3.9. Apple App Store or Google Play may withdraw the App at any time. We shall let you know of this in advance if we are able to do so.
3.10. We may update the App or Service and/or OS without notice to you. We may make any updates available to you for download or as a non-optional download. These Terms shall apply to any such updates and may be subject to additional or updated terms and conditions which will be available for you at the time of download.
3.11. You may not be able to use the App until you have downloaded the latest version of it and accepted any additional or updated terms and conditions that may apply.
3.12. You may be required to upgrade the OS on your Mobile Device if we make any updates and change the versions on which we run the App.
3.13. If you use the App or Service outside of the UK you are responsible for complying with any local restrictions and relevant law when downloading or using the App and Service.
3.14. All copyright, trade marks, design rights, patents and other intellectual property rights (registered and unregistered) (the “Rights”) in and on the App and Service belong to us and/or third parties. We reserve all Rights in and on the App and Service. Nothing in these Terms grant you any right or license to use any Rights owned or controlled by us or any other third party except as expressly provided in the Terms.
4. Termination and deleting the App
4.1. If you wish to terminate this Licence and your use of the App and Service you may do so by immediately deleting the App from your Mobile Device(s) and complying with any requirements set out in your Cambridge Building Society account terms and conditions.
4.2. In the event you change your Mobile Device or dispose of it you must delete the App from the Mobile Device to prevent it being used by others without your consent.
4.3. We will endeavour to provide you with one months’ notice if we intend to end, limit or suspend the Licence and your use of the App and Service.
4.4. We may however terminate, limit or suspend the Licence and your use of the App and Service immediately without notice to you; including but not limited to the following circumstances:
a) if you breach any of these Terms;
b) if we have any concerns about your Security Details or suspect that your Security Details have been compromised, used fraudulently or in an unauthorised way or if we have concerns over any unusual or suspicious activity on your account(s) or Service;
c) if you have not used the Service or App for 12 months in which case you will need to re-register;
d) if you cease to have any account, product or Service with us;
e) if your Security Details are entered incorrectly more than 3 times in which case you will need to contact us by telephone to unlock your account;
f) if our App or Service is no longer supported on your Mobile Device or OS;
g) if we suspect any illegal activity;
h) if we are legally obliged to do so;
i) in any other circumstance where it would be reasonable for us to terminate, limit or suspend your use of the Service or App.
5. Cookies, Privacy and Communication
5.1. By downloading the App and accepting these Terms you are also consenting to the use of cookies on your Mobile Device. Our cookies policy can be viewed here.
5.2. Cookies are required for the functionality of the App and to provide the Service. We will collect information such as your Mobile Device name, manufacturer, model, OS, OS version, App version, date and time of registration, whether you are using biometrics, location, the eBanking Mobile Web API version in use and other data as shall be required from time to time. Future cookies used by the App shall be added to this list from time to time and the date and version number of the Terms update will be amended accordingly.
5.3. The use of the Service through the App may require your consent for us to use information about your location. You will be asked for your consent before you access the App and can switch this functionality on or off using the settings on your Mobile Device.
5.4. Any information provided by you will be held and used in accordance with our privacy policy which can be viewed here.
5.5. You agree that we may contact you from time to time by post, email, SMS text, in App notification, via secure messaging or telephone regarding the App or Service. You can opt in to receiving marketing promotions and information on other products and services that we consider may be of interest to you within the settings section of the App.
6. Keeping your details secure
6.1. You are responsible for keeping your Security Details you enter to access the Service and App secure at all times.
6.2. We will never ask you for your Security Details and if you receive such a request, you should refuse and contact us immediately by telephone on 0345 601 3344 to report any such request.
6.3. You must have unique Security Details which are not known to others or easy to guess.
6.4. You must not tell anyone your Security Details and you must take all reasonable steps to disguise your Security Details so that they cannot be decrypted by others.
6.5. You must keep your Mobile Device itself secure at all times and make use of any additional secure login features provided by the Mobile Device manufacturer to keep the Security Details secure.
6.6. You must ensure that you log out of the App and Service after you have finished using the Service.
6.7. If you use a biometric logon facility (such as Apple TouchID), then any person whose fingerprint is registered to your Mobile Device may be able to login to your account. Transactions made by a registered finger print will be treated as being authorised by you and you will be liable to this extent. It is therefore advisable that you ensure you are the only registered fingerprint before activating and using this feature.
6.8. You must take all reasonable steps to scan for viruses or malicious software which may access your Security Details.
6.9. If you suspect someone else knows your details or if you notice suspicious activity on your account or you lose your Mobile Device or if you suspect that your Security Details have been compromised in anyway whatsoever you must take all steps to change your Security Details and immediately contact us by telephone on 0345 601 3344 so that we can take the appropriate action.
7. Guarantee of Availability
7.1. Whilst we will try to make sure that the App and Service is available for your use, we do not represent, guarantee or make any promise regarding the App’s availability, functionality or compatibility and nor do we promise the uninterrupted use by you of the App or Service.
7.2. We do not guarantee that the information you are able to view on the Service or App is in real time and you should allow 48 hours for information such as transactions to show.
8. Liability and unauthorised transactions
8.1. We shall not be liable for any loss suffered by you as a result of the Service or App being unavailable. This includes Service or App unavailability caused by:
a) maintenance updates or upgrades by us to the Service or App; or
b) where your mobile network operator coverage is not sufficient to use the Service or App; or
c) where your Mobile Device OS or other software requires updates or becomes insufficient to support the Service or App; or
d) where we are required to remove the Service or App by virtue of law.
8.2. We shall not be liable where you have not used the Service or App in accordance with these Terms and any other specific terms that govern your use of your Cambridge Building Society accounts.
8.3. You should refer to the general terms and conditions applicable to your account in respect of unauthorised transactions. You will be liable for any loss resulting from an unauthorised transaction if you have:
a) not acted in accordance with these Terms (with particular reference to clause 6);
b) acted fraudulently;
c) authorised the transaction or given access to the account (whether intentionally or not);
d) been grossly negligent, including failing to keep your Security Details secure and not immediately informing us if you think your Security Details have been compromised in anyway.
8.4. We shall have no liability for any breach of these Terms caused by any event or circumstance beyond our reasonable control including, but not limited to, breakdown of systems or network access; war, cyber or terror attack; or severe or unusual adverse weather, flood, fire, explosion or accident.
9. Responsibility of Joint Account Holders
9.1. If you are a joint account holder you will be required to individually register for access to the Service and App in accordance with clause 2 of these Terms.
9.2. Instructions for joint account holders may be given by each and any of those account holders.
9.3. Each account holder accepts that they are jointly and severally liable for all monies due or liabilities incurred arising from any instruction given in accordance with these Terms.
9.4. Each account holder must act in accordance with these Terms and any provisions of these Terms shall have effect as if they were joint and several obligations by each account holder.
10. Variation of Terms
10.1. We may vary these Terms at any time and we will notify you of any amendment via: email, through the secure messaging service, via push notifications or by notification straight to your mobile through the App. It is your responsibility to check these Terms from time to time to verify such variations.
10.2. You will be required to accept the new terms to continue using the Service and App or you will be able to discontinue your use of the Service and delete the App.
11. Miscellaneous
11.1. No one other than you has any right to enforce any of these Terms.
11.2. If any Term is or becomes illegal, invalid or unenforceable, the legality, validity and enforceability of any other Term shall not be affected.
11.3. Nothing in these Terms shall affect your statutory rights. For more information, please contact your local Citizens Advice Bureau or local authority Trading Standards Department.
12. Complaint
If you have a complaint, please notify us by following our complaints procedure which is available on our website at: Dealing with Complaints.
13. Governing Law and Jurisdiction
13.1. These Terms (including the Licence) are governed by the law of England and Wales.
13.2. All disputes under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
